Terms of Service
1. The service
Photo Community is a marketplace where photographers publish event albums and organisers unlock and download full-resolution photos. To be expanded.
2. Accounts
You must provide accurate details and keep your credentials secure. You are responsible for activity under your account. Roles: photographer, organiser, admin.
3. Photographer obligations & content
Photographers warrant they own or have the rights to the images they upload and have obtained the necessary consent from identifiable people (portrait rights / AVG). Prohibited content to be listed. Photo Community may remove content that violates these terms.
4. Payments, pricing & revenue share
Album access is sold at a price set by the platform. The photographer earns 33.3% of each first-year unlock and 10% of each renewal; the platform retains the remainder to fund hosting and delivery. Payments are processed by Stripe. VAT/tax handling and the merchant-of-record arrangement to be confirmed by lawyer/accountant. (Payments are currently paused during testing.)
5. Licence to downloaded photos
Define what an organiser/guest may do with downloaded photos (personal vs commercial use), and what rights the photographer retains. To be drafted.
6. Retention & availability
Unlocked albums remain available for a defined period (currently up to one year, renewable) after which they may be purged. No guarantee of uninterrupted availability.
7. Liability & disclaimers
Standard limitation-of-liability, warranty disclaimer, and indemnity clauses to be drafted by lawyer.
8. Governing law
These terms are governed by Dutch law; disputes before the competent court in the Netherlands. To be confirmed.
